Terms of Bidding​

1. The commencement of bidding shall occur at a price determined at the sole discretion of the auctioneer, who retains the exclusive right to withdraw any lot from the auction for reasons deemed justifiable at their discretion. No bid shall be accepted that is less than half of the low estimate for any item, regardless of the method of bidding, whether by telephone, absentee, internet, or in-person gallery bid.

2. All lots offered within this catalog are subject to a reserve, which constitutes a confidential minimum hammer price. In furtherance of executing such reserve, the auctioneer is authorized to bid on behalf of the consignor, whether by initiating the bidding process or continuing the bid until the reserve price is met.

3. Should the reserve price remain unmet, the auctioneer may withdraw the item from the sale without recourse. Upon the declaration of an item as 'sold' the transaction shall be deemed final and irrevocable, and no further bids will be entertained. It is the bidder's explicit responsibility to ensure that they attract the auctioneer's attention prior to the conclusion of the sale. The auctioneer further reserves the unfettered right to reject any bid deemed to be inappropriate or to withdraw any item for lack of adequate or appropriate bids. Should an item be withdrawn, it will only be offered again at the discretion of the auctioneer.

4. Sevens A&A Inc. extends the privilege of absentee and telephone bidding to prospective participants who are unable to attend the sale in person. All absentee bids shall be executed in strict confidentiality and competitive in nature. Reservations for telephone bidding must be received no later than 5 p.m. on the day prior to the auction. No telephone bidding reservations shall be accepted after this time. By submitting an absentee or telephone bid, the bidder consents to open the bidding at the starting bid level as determined by the auctioneer.

5. For bids where the opening bid is $1,000 or greater, Sevens A&A Inc. reserves the right to charge the bidder's credit card a deposit equivalent to the opening bid amount. This deposit will be refunded should another bidder successfully win the item. A buyer's premium of 28% shall be levied on the final hammer price of all lots. The buyer assumes full responsibility for securing any necessary export, import, firearm, endangered species, or other relevant permits for any item purchased. Any symbols or notices within the catalog are intended solely for guidance, and Sevens A&A Inc. makes no express or implied representation regarding the subject of export or import restrictions, embargoes, or permits related to any lot. The buyer must independently verify and secure all relevant documentation for international or specialized transactions. Sevens A&A Inc. shall not be held liable for any damage or loss incurred during the shipping or handling of purchased items, except in cases where Sevens A&A Inc. itself is responsible for the shipping. In such cases, Sevens A&A Inc. shall submit a claim to the designated carrier for reimbursement of any damage sustained during transit. However, should the buyer select an independent third-party shipping service, Sevens A&A Inc. assumes no liability whatsoever for any damage or loss sustained during transport. In such instances, all claims, disputes, and resolutions regarding damage shall be the sole responsibility of the chosen carrier or the buyer, and Sevens A&A Inc. shall not be involved in such matters. Sevens A&A Inc. expressly disclaims any representations or warranties regarding the electrical components, wiring, or functionality of lamps or lighting fixtures sold at auction. It is the buyer's sole responsibility to ensure that all electrical elements are inspected, maintained, and installed by a certified professional. Sevens A&A Inc. shall not bear responsibility for any damages, injuries, or malfunctions arising from the use or improper installation of such items. By participating in this auction, the buyer acknowledges and accepts this full disclaimer without exception. Sevens A&A Inc. shall bear no liability in the event an item is subsequently found to be counterfeit, stolen, or subject to legal disputes of ownership. Should an item be damaged or misrepresented by the consignor, Sevens A&A Inc. will undertake reasonable efforts to resolve such issues in a manner that is mutually beneficial to both the buyer and the consignor. However, Sevens A&A Inc. shall not be held liable for human error, including but not limited to typographical errors, or discrepancies between the catalog and the actual lot. All such matters shall be resolved through amicable negotiation, and Sevens A&A Inc. will not be held accountable for any factual inaccuracies or omissions within the catalog descriptions. Upon the conclusion of the auction, the winning bidder shall receive an invoice containing comprehensive details regarding the transaction and methods of payment within 24-72 hours. The buyer is required to settle the full purchase price within 50 days from the auction's close. Should payment not be received within this period, the buyer will incur a storage fee of $7 per day for each lot, which shall continue to accrue until full payment and collection of the item(s) are completed. If the payment, inclusive of any storage fees, is not settled within an additional 50-day period (i.e., 100 days from the auction's conclusion), the sale shall be automatically cancelled, and the item shall revert to Sevens A&A Inc. ownership. Furthermore, a dispute will be filed with LiveAuctioneers, and the buyer shall forfeit the item, with no entitlement to reimbursement. All items must be retrieved no later than 100 days from the auction's conclusion. Should the buyer fail to collect the item by this deadline, the sale will be nullified, and a formal dispute will be initiated with LiveAuctioneers, potentially resulting in further legal recourse. By participating in this auction, all bidders unequivocally acknowledge and agree to the terms outlined herein. Any breach of these Terms and Conditions, including failure to remit payment for purchased items, may result in legal action, cancellation of the sale, and the re-offering of the property. Sevens A&A Inc. expressly reserves the right to withdraw any item from the auction at any time for any reason and to cancel any sale in the event of an error, dispute, or failure to meet the necessary terms and conditions.
